W. Tapp 2210 32nd Ave. South. – Seattle, WA – 98144 BIOGRAPHICAL SKETCH Mr. Tapp is an arbitrator in private practice specializing in employment arbitration. In addition, he undertakes neutral fact-finding and provides expert consultation on federal-sector discipline/discharge cases. He is on the FMCS roster of arbitrators and permanent panels for the GSA/AFGE, Council 236 (Region 9), and the NTEU/IRS (Western Region). He is the co-author, with Sam Vitaro, of "Understanding the Merit Systems Protection Board Process" (Labor Relations Press, 2007). Between 1980 and 2005, he served as an administrative judge with the Merit Systems Protection Board, a federal agency. At the Board, he conducted hearings and issued decisions involving termination and other discipline for various offenses (e.g., sexual harassment, threats, insubordination, drug use, drug testing, and computer pornography), performance issues, EEO claims (e.g., disability, race, sex, religion, and reprisal), and other prohibited personnel practices (e.g., retaliation for whistleblowing, discrimination against veterans). During his years with Board, he was rated either “highly successful” or “outstanding” (two top ratings in a five-level system) and was twice awarded the Chairman’s Award for Legal Excellence. From 1974 through 1980, he was a Deputy Defender in the Federal Public Defender Offices in Detroit and Seattle. During his years with the Federal Defender, he did both trial work in U.S. District Court (winning five of eight jury trials) and appellate work before the Sixth and Ninth Circuit Courts of Appeals. From 1968 through 1971, he was the Assistant to the Vice-President for Student Affairs and a history instructor at Oakland University in Rochester, Michigan. Mr. Tapp received his J.D. from Wayne State University in Detroit, an M.Ed. from Ohio University in Athens, Ohio, and a B.A. from Denison University in Granville, Ohio.
