ARBITRATION EXPERIENCE:
2004 – Present: As an Arbitrator,
arbitrates securities and employment cases for FINRA (previously NASD) and am
currently engaged in developing a full time neutral practice in Labor and
Employment law.
WORK EXPERIENCE
General Summary: Over 36 years experience in the electric utility power
generation industry. Held several union represented positions during the first
21 years, beginning as a laborer and working up through plant operations, fuel
processing, and ending as a journeyman maintenance electrician.
After accepting a management position as an electrical maintenance
supervisor in 1992, moved into human resources in 1996 and eventually became the
head of the industrial relations department in 2004, a position held until
retirement at the end of 2007.
Labor Advocacy Summary: 2004-2007:
Manager of Industrial Relations and Process Improvement with responsibility for
all companywide labor relations activities with particular emphasis on
preparing, negotiating and interpreting labor contracts and for providing
leadership in grievance and arbitration cases.
Also was responsible for the company’s internal non-financial auditing
and undesired event investigation (root-cause analysis) processes.
1996-2004: Was a member of the
company’s human relations department with multiple responsibilities in the
areas of labor and employee relations. Duties
included grievance and arbitration administration and serving on management’s
contract negotiating team. 1992-1996:
Was a maintenance supervisor with additional duties as a member of
management’s labor contract negotiating team.
1985-1992: Was an electrician
and served as a union steward and 3-time member of the union’s labor contract
negotiating team.

ISSUES: Extensive experience as an
advocate and/or neutral in a wide range of labor and employment issues
including, but not limited to: job performance, bonus/incentive pay, working
conditions, past practice, discipline, discharge, work jurisdiction, management
rights, union security, bidding, overtime, bargaining unit work, seniority,
bidding, job classifications, work hours/schedules, subcontracting/contracting
out, etc.
FEES:
Per Diem: $1,100 per day of hearing (hearing day is any portion of
day up to 8 hours) with research, award preparation, and extended hearing days
prorated @ $137.50/hour; Docketing: None;
Cancellation: Per diem for each
scheduled day if cancelled with 7 or less day’s notice; Travel from above business address: ˝ day per diem for one way
travel greater than 3 hours if traveling during normal business hours M-F.
No charge for Sat or Sun travel. Actual
charges of reasonable expenses including car rental, food, lodging, etc.
Personal auto charged at IRS rate. Copying,
phone, or clerical functions only charged if total cost exceeds $100 per case.
